Court: No right to resist illegal cop entry into home

INDIANAPOLIS | Overturning a common law dating back to the English Magna Carta of 1215, the Indiana Supreme Court ruled Thursday that Hoosiers have no right to resist unlawful police entry into their homes.

In a 3-2 decision, Justice Steven David writing for the court said if a police officer wants to enter a home for any reason or no reason at all, a homeowner cannot do anything to block the officer’s entry.

Jumpin’ Jeebus! An American *always* has the right to resist an illegal act.

  1. Sounds like a bad April Fool’s Day Joke. At least the people involved will have an excellent case against the Indianapolis police and court system. I can see both the Conservatives and Liberals getting all riled up about this one, especially the ACLU. The ACRU is also going to have fun with this one.

    Since when did the Indiana Supreme Court get the power to supersede the Constitution of the United States?

    All I can wonder is: What’s Next?

  2. Amendment 4 – Search and Seizure. Ratified 12/15/1791.

    The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

  3. Depends on what your definition of “unreasonable” is. If the cops make a mistake, break down your door and kill your pets is that really “unreasonable”? I mean everybody makes mistakes.

    This type of thing seems to be accelerating given the Souter “We can take your property even if it only increases our campaign contributions” revision. It’s as if the Nazis left off attacking the 2nd amendment so they could concentrate on the smaller obsticles first.
